By using the JustYellOut.com service you do not obtain the right to use any copyright, design, patent or registered trademark or service mark or other right of the Service owner or third party. These representations are valid for any other copyright or other content on JustYellOut.com protected by copyright or other intellectual property right of the Service owner or third person, unless for particular content it is expressly stated otherwise.

COMMERCIALS AND ADVERTISING
On JustYellOut.com web pages there are and will be commercials in different forms, such as direct (commercials, announcements etc.) or indirect commercials (but not hidden advertising) in the profiles of legal persons, our registered Users, then viral photo and video records or natural and legal persons available for download to the Users personal computer (download on „Free and Fun“ function) or via special contractual relation between the Service owner and third persons (e.g. through banners and similar).
JustYellOut.com in its database adjusted for download within the Free and Fun“ function shall provide free download of databases with such commercial contents to its Users (viral photo and video records) which Users can post and download at their own responsibility pursuant to all provisions of Terms of use (natural persons can post such content free of charge and legal persons with a fee to the Service owner, pursuant to the applicable price list).
Also, within the service database functions „I got“ and „I need“ all Users shall be able to completely free of charge post their personals of non-commercial content (offering and/or asking and/or exchange of certain information, data, pictures or videos, services, items etc.). Every natural person shall be entitled to unrestrictedly post his/her personals, whereas legal persons shall be entitled to post their ads so that one key word („tag“) is free, and all other key words shall have to be rented from the Service owner pursuant to the applicable price list. Persons posting one of the specified forms of personals or ads or using any other form of advertising (hereinafter referred to as: “advertising”) for the purposes of text in this section hereof shall be referred to as advertiser or advertisers.
It is particularly emphasized that the list of advertising forms specified herein is not final and it is possible that some other forms, not listed herein, shall be used.
All contractual and other relations in which the Users entered with persons advertising on our web site shall be regulated by Users directly with the publishers. Service owner, JustYellOut.com or employees are not included in these relations and assume no liability whatsoever therefrom. Should you be in contact with persons advertising on JustYellOut.com pages, by accepting these Terms of use you agree to regulate the above-mentioned relations directly with advertisers.
It is strictly forbidden to publish ads on JustYellOut.com in any other way than allowed by the JustYellOut.com service.
JustYellOut.com does not support misleading advertising or advertising which is likely to mislead target persons and likely to influence economic behavior of such persons (misleading advertising).
Furthermore, to the maximum extent permitted by law and regulations, the liability of JustYellOut.com service, its owner and employees is excluded, for any type of damages sustained by Users or third natural or legal persons by natural or legal persons using the advertising prohibited by law. Should you have any complaints, questions, claims or plaints related to such advertising or its consequences, by accepting these Terms of use you agree to direct them against the User who posted the disputed content, be it natural or legal person.
JustYellOut.com service and its owner shall use their best efforts to prevent advertising prohibited by law from appearing on its web pages between ads, including, but not limited to, advertising which might cause physical, physical or consequential or any other type of damage, which is against human dignity, misleading advertising and advertising causing certain economic behavior of persons exposed to it, unethical advertising and similar.
Advertiser warrants and represents that:
- s/he is the owner of items offered in the service database on the Service web site,
the state of item offered is as described on the Service web site,
- s/he is an actual expert in the field s/he claims to have expert knowledge,
- anything s/he offers in the service database has been acquired legally and use of that item shall not infringe anyone’s right,
- product/service and/or ad content does not contain discriminating aspects or prohibited or materials not allowed by Croatian law,
- ad is no sense whatsoever insulting towards JustYellOut.com or third persons,
- goods advertised are not stolen or illegal,
- ad is not about advertising with the purpose of providing services prohibited by law, indecent or immoral services and similar,
- in order to execute ownership, copyright or other intellectual property right s/he accesses the service database no third party permission is required and that s/he infringes no copyright or other intellectual property rights,
- ad does not represent hidden advertising or marketing,
- ad’s aim is not to advertise the company, directly or indirectly.
Service owner is entitled (it may, but is not required to, therefore, no obligations assumed) arrange, modify or delete all ads not in compliance with the representations and warranties above given by the advertisers or in case they prove untrue or in case any default or abuse of advertising is observed, as well as in cases when the ad has been posted in the incorrect category or if ad is not in compliance with these Terms of use in any other way.
Advertisers shall fully indemnify Service owner in case of any third party claims against the Service owner due to infringement caused by ad’s content posted on the service web site or default of specified representations and warranties or default against these Terms of use or any other existing regulations.
Advertisers on JustYellOut.com agree to hold harmless the Service owner against any harmful consequences arising from the service not being provided as it was described in the ad. JustYellOut.com accepts no liability nor represents and warrants for any service or item advertised on these pages, including ownership and rights related therewith regarding any item or service, accuracy or truth of ad description, User's readiness to accept item or service from the ad or similar. Advertiser and other Users shall perform service and their other obligations as described in the ad and accepted as such by other User(s). Advertisers at JustYellOut.com agree that all contacts shall be made solely at their own risk and agree that JustYellOut.com and Service owner shall not have any liability or obligation for any harmful consequences arising by the advertiser and/or advertiser and User interactions.

JustYellOut.com grants non-exclusive, limited right to post a link to the Service first page (splash) to every natural or legal person under the condition that JustYellOut.com service in such connection is not represented in untrue, incorrect, malicious, insulting manner or any other manner harming the Service reputation, its employees and associates, Users, Service owner or anyone in contact with the Service. This right may be terminated at any time, and any such possible decision shall be valid from the day of publishing on JustYellOut.com pages or in the moment of sending notice by email to the particular natural or legal person whose right is terminated. PROHIBITED CONTENT
It is prohibited to post any data, ads, texts, photo or video material, films etc. the contents of which is against the existing legislation of the Republic of Croatia and thus also international regulations that apply in the Republic of Croatia. Also, everything that infringes the reputation of this Service, Service owner, employees or associates or users is prohibited. Should we note such data, content and actions or in case we are warned thereof by a third party, they shall be promptly removed, and the User temporarily suspended. In case of heavier and/or repeated infringement of the Terms of use or existing regulation, user(s) account shall be terminated and user(s) profile erased with all its content and without prior warning, e.g. this agreement shall be terminated.
Although the prohibited content and methods of using JustYellOut.com service are not limited to the following list, nevertheless, is particularly prohibited:
- Harm in any way, and especially to endanger life, physical and mental health of anyone and particularly minors;

At the same time, Service owner and Service may not guarantee that some of your personal data obtained in the registration process and later shall never be accidentally disclosed, against the Service privacy protection policy. Should such thing happen, we shall not be liable to the maximum extent provided by law for damages sustained by Users or third parties. It is especially emphasized that such thing may occur due to the fact that the Service does not have the possibility to influence the events in your registration process and after the registration process on a series of other Internet web sites, in addition to the communication process with the organizers of games of chance and sponsored content accessed by our Service.
The above-mentioned presumptions are considered non-abatable (praesumptio juris et de jure).
REPORT ON DEFAULT OF TERMS OF USE

TERMINATION
Service owner may terminate user account and exclude from any right to use the JustYellOut.com service and delete the profile, e.g. terminate this agreement in respect of any User, at any time, without reason or cause, without prior or subsequent notice on termination of the agreement and termination of user profile and exclusion from right to use the Service. Users agree and are fully familiar with this authorization of the Service owner.
Specified actions and measures may be taken especially regarding the User which in any way defaults against the Terms of use or default done by third person with access to his/her profile, in any way obstructs the web site operation or in any way infringes or violates the rights of other Users, Service owner, its employees or associates or any third person, abuse posted content pr rights and possibilities provided on the JustYellOut.com web site or in any other way uses JustYellOut.com without authorization.
Each User fully and unrestrictedly agrees that in case of termination of the agreement and deleting User profile by the Service owner, the Service owner is free from any liability (physical, consequential liability for damages, criminal liability and similar) against User the agreement has been terminated with and profile erased or towards third persons.
Moreover, each User is entitled to terminate this Agreement at any time by sending notice via email to the address support@justyellout.com and in the notice specify that s/he terminates this agreement and wishes for his/her profile to be deleted. Upon receiving such notice JustYellOut.com shall delete the profile and all data and content thereon, and the agreement shall be deemed terminated on the moment JustYellOut.com deletes the profile with all data and contents thereon. JustYellOut.com shall use its efforts to act on the notice received as above in the reasonable period of time (24 hours from receipt of this note), but it is possible that in case of technical difficulties, force majeure and similar reasons this period is longer.
In case of termination of the agreement from any reason by the Service owner or User, and in case the User has caused damages to the Service owner, other users or third parties, User’s potential liability shall not cease by the termination itself and deleting his/her user account and profile.
JUDICIAL COMPETENCE IN CASE OF DISPUTE AND APPLICABLE LAW
In case of disputes related to use of JustYellOut.com service, competent shall be the subject-matter competent court of Zagreb, Republic of Croatia, and Croatian law shall apply.
LANGUAGE OF TERMS OF USE
In case that JustYellOut.com web site provides the translation of Terms of use from Croatian to English or other language, you agree that the translation or translations have been posted to the JustYellOut.com web site for information only for Users not in command of Croatian language, but that Terms of use in Croatian shall exclusively apply.
